SVG Yachting Ltd — Booking Terms & Conditions

These terms govern yacht charters and related services arranged by SVG Yachting Ltd (registered office: 128 City Road, London EC1V 2NX, United Kingdom) between the Company and the lead charterer ('you') and every member of the charter party.

1. Role of SVG Yachting

SVG Yachting Ltd acts as an independent charter broker. We match charterers with yacht owners and operators ('Yacht Operators') and provide concierge, shoreside and marine services in support of the charter. Except where we are the Yacht Operator ourselves, the charter contract is between you and the Yacht Operator, on that operator's standard charter agreement (typically MYBA, CYBA or a comparable form). We remain your point of contact throughout.

2. Booking, deposit and balance

  • A booking is confirmed once we have received a signed charter agreement and cleared deposit.
  • A non-refundable deposit of 50% of the charter fee is payable on booking.
  • The balance (charter fee, Advance Provisioning Allowance and any local taxes) is payable no later than 60 days before the charter start date.
  • For bookings made within 60 days of the charter start date, 100% of the charter fee, APA and taxes are payable at the time of booking.

3. Payment

Payments are made by bank transfer to the account nominated on your invoice, or via the secure card-payment link we provide. All bank charges are for your account. Charter fees are typically quoted in EUR or USD; prevailing exchange rates apply on the date funds are received.

4. Advance Provisioning Allowance (APA) and local taxes

Crewed charters are quoted plus APA (usually 25–35% of the charter fee) and applicable VAT or local taxes. APA covers on-board fuel, provisions, dockage, port fees and similar running costs; an itemised reconciliation is provided at the end of the charter and any balance is refunded or collected on board. St Vincent & The Grenadines cruising taxes and permits are payable in addition and vary by yacht size.

5. Cancellation by you

All cancellations must be made in writing. The following charges apply as a percentage of the total charter fee unless the Yacht Operator's contract specifies otherwise:

  • More than 90 days before charter start: deposit forfeited (50%).
  • 60–90 days before charter start: 75% of the charter fee.
  • Less than 60 days before charter start: 100% of the charter fee.

We strongly recommend comprehensive travel and charter cancellation insurance to cover these exposures.

6. Cancellation or substitution by the Yacht Operator

If a yacht becomes unavailable through mechanical breakdown, damage, sale or other cause outside the Yacht Operator's control, we will endeavour to arrange a comparable substitute yacht at no extra cost. Where a substitute is not accepted, all monies paid for the yacht will be refunded in full; SVG Yachting is not liable for consequential losses (flights, connecting travel, lost holiday time).

7. Force majeure

Neither SVG Yachting nor the Yacht Operator is liable for failure to perform where prevented by events beyond reasonable control, including but not limited to hurricanes, tropical storms, adverse weather, government restrictions, epidemic or pandemic, port closures, industrial action, war, civil unrest or acts of terrorism.

8. Insurance

Comprehensive travel insurance covering medical evacuation, personal accident, cancellation and curtailment is a condition of every charter. Bareboat charters additionally require charterer damage-waiver insurance or an accepted security deposit; details are set out in the charter agreement. Proof of insurance may be requested before boarding.

9. Bareboat qualifications and the sailing area

Bareboat charterers must produce sailing qualifications acceptable to the Yacht Operator (e.g. RYA Day Skipper or International Certificate of Competence) and a sailing CV demonstrating recent, comparable experience. Cruising is limited to the permitted sailing area described in the charter agreement; night sailing and single-handed sailing are generally prohibited.

10. Behaviour on board and health & safety

You are responsible for the safety and behaviour of your party. The captain has final authority on all matters of safety, navigation and itinerary. Illegal drugs, firearms and unauthorised pyrotechnics are strictly prohibited on board. Guests must disclose material medical, dietary and mobility needs at the time of booking.

11. Complaints

Any complaint arising during a charter must be raised with the captain immediately, and with SVG Yachting by email to info@svgyachting.com within 14 days of disembarkation. This gives us the best chance of resolving matters with the Yacht Operator on your behalf.

12. Liability

SVG Yachting Ltd acts as agent for the Yacht Operator and is not liable for personal injury, loss of life, illness, delay, loss or damage to property or any indirect or consequential loss arising in the course of a charter, save to the extent such liability cannot lawfully be excluded. Nothing in these terms limits liability for death or personal injury caused by negligence, or for fraud.

13. Data protection

Personal data is handled in accordance with our Privacy Policy.

14. Governing law

These terms are governed by the laws of England and Wales, and any dispute is subject to the exclusive jurisdiction of the English courts, save that Yacht Operator charter agreements may specify a different governing law and jurisdiction which will prevail as between you and the Yacht Operator.
